Check eligibility and the holding agency
Section 2.2-3704 provides access rights to Virginia citizens and specified newspaper, magazine, radio and television representatives serving Virginia. A custodian may request a name and legal address. State an accurate eligibility basis. Virginia law: requests and responses
The FOIA Council advises sending requests to the holding body's FOIA officer. Its 2026 guidance says a written request is useful but not required, and an agency cannot insist on its particular form or online portal. Virginia FOIA Council: 2026 guidance
For Virginia State Police records, its FOIA page lists its portal and other channels, including email, mail, fax, phone and in-person requests. A local department's records belong with that department, using its own contact instructions. Virginia State Police: request channels
Count working days and distinguish responses
The Council's 2026 quick reference gives five working days for the initial response, excluding weekends and legal holidays. Its longer guide counts the day after receipt as Day 1. The allowed response can provide records, withhold all or part, report missing records, or properly invoke more time. Virginia FOIA Council: June 2026 reference · Virginia FOIA Council: 2026 guidance
Section 2.2-3704(B)(4) allows seven additional working days after a timely written explanation when the initial response is not practicable. It separately provides 60 working days for specified criminal-investigative-file requests. Neither extension should be presented as an automatic deadline for every police record. Virginia law: requests and responses
The statute also permits a court petition for extraordinary volume or search length after reasonable efforts to agree with the requester. Preserve any extension notice or production agreement. Virginia law: requests and responses
Ask for a cost estimate and answer it
The Council's quick reference explains actual-cost charges, advance estimates on request and possible deposits above $200. Estimate and deposit procedures can pause the response clock. Virginia FOIA Council: June 2026 reference
Section 2.2-3704(F) says the clock pauses between the cost-estimate notice and the requester's response. No response within 30 days of the estimate makes the request withdrawn. Keep that notice and reply promptly. Virginia law: requests and responses
Separate accessible portions from withholding
The Council's 2026 guidance describes written withholding responses identifying the subject matter and legal authority, plus volume when the entire record is withheld. It explains that nonexempt portions generally must be provided. Virginia FOIA Council: 2026 guidance
Copy and adapt this request
Replace every bracketed field, use an accurate eligibility statement and narrow the dates. The template requests existing governance records and does not send a request.

If the response remains disputed
The FOIA Council supplies advice and educational material; its quick reference says it is not a repository for other agencies' records. Use its current contact details for a procedural question. Virginia FOIA Council: June 2026 reference
Section 2.2-3713 provides court enforcement by petition for mandamus or injunction, supported by an affidavit showing good cause. Venue depends on whether the body is local, regional or state. Preserve the request, notices and denial when reviewing that statutory route. Virginia law: court enforcement
