Start with the holding agency's adopted OPRA form

The GRC says agencies must adopt its established OPRA form and directs requesters to the holding agency's website for that form and submission instructions. Use the template below as a records description to adapt into that process. New Jersey GRC: adopted agency form

Its request guidance allows the adopted form or a written equivalent containing all required form information. Required certification questions concern indictable-offense convictions, commercial use and records connected to a legal proceeding, including case identifiers when applicable. Answer them truthfully. An incomplete equivalent can be denied. New Jersey GRC: complete requests and certifications

Choose identity and delivery information deliberately

The GRC says out-of-state and commercial requesters can use OPRA. It permits anonymous requests, subject to the victims'-records restriction, but says anonymous requesters cannot bring an OPRA complaint to the GRC or courts. Review that consequence before choosing an anonymous route. New Jersey GRC: requester and access questions

The amended text requires each submission to go to the custodian of no more than one public agency. It also addresses repeated substantially similar requests to multiple custodians within the same agency while one is pending. Send one complete request to the proper custodian and keep it. New Jersey GRC: amended OPRA text

Check the applicable response category

The GRC describes a general seven-business-day response after a complete request. It identifies fourteen business days for commercial-purpose requests or specified Daniel's Law review, with notice of the extra time within seven business days. It also lists emergency rules, small-fire-district adjustments and reasonable extensions. This is not an unconditional seven-day delivery promise. New Jersey GRC: timing and exceptions

Its FAQ identifies an immediate-access category including contracts, with the 2024 amendment limiting that category to records no older than 24 months. It describes possible processing circumstances such as volume, use, storage or conversion. Identify the contract dates and check the applicable access category. Ask about fees and any special service charge

The GRC says electronic records are generally free, with limited production-fee circumstances. It separately describes copying/media charges, special service charges for the stated extraordinary work, and possible deposits when reproduction costs exceed $5. Request the fee basis before authorizing costs. New Jersey GRC: charges and deposits

Copy and adapt the records description

Complete the agency's entire adopted form, including its certifications. Replace the bracketed record types, dates and cost threshold below. This site does not submit the request.

To: [Holding agency's records custodian]

Date: [MM-DD-YYYY]

Subject: OPRA request: existing plate-reader governance records

I request electronic copies of the following existing records held by [agency] for [start date] through [end date]:

1. Plate-reader operating policies, retention schedules, audit procedures and training materials effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing lists of sharing partners and executed data-sharing agreements effective during the period.

4. Existing aggregate compliance or system-use audit reports for [narrow date range], subject to applicable exemptions and lawful redaction. This request concerns governance rather than an individual's movement history.

Please provide accessible electronic records or specific public links where applicable. Please identify the legal basis for withheld portions and provide the accessible remainder.

Please contact me with an estimate before charges exceed [$ amount], including the basis for any special service charge. I can discuss narrowing the request.

For additional response time, please provide the applicable notice and expected completion date.

Requester information and certifications: [Complete the agency form accurately, including its identity/contact, commercial-purpose, conviction and legal-proceeding questions as applicable]

Preserve the complaint deadline and choose a review route

Section 47:1A-6 in the GRC's amended OPRA text gives an accurately named requester 45 days from denial to choose a Superior Court action or, instead, a GRC complaint. Keep the denial and receipt dates, and check the applicable deemed-denial timing promptly if the custodian does not respond. New Jersey GRC: amended OPRA text

The GRC filing page describes 45 calendar days, or the next business day thereafter, and requires its Denial of Access Complaint Form. It lists mail, email and fax submission and says it no longer supports the former e-filing system. Use its current instructions and contact the GRC about a timing question; the initial request template is not a complaint form. New Jersey GRC: complaint filing and time limit

Questions and answers

Can I send only the downloadable text and omit the agency form questions?

The GRC requires all information on the adopted form, even in a written equivalent. Adapt the text into the full agency process. New Jersey GRC: complete requests and certifications

Does every OPRA request have the same seven-business-day period?

The GRC lists shorter access categories, fourteen-day categories, emergency provisions and other qualifications. Check its current timing guide. New Jersey GRC: timing and exceptions

Can an anonymous requester file a GRC denial complaint?

The GRC says anonymous requesters cannot institute that complaint process. Accurate identification is required. New Jersey GRC: complaint filing and time limit
