Send a precise request to the holding body

Maine has no central FOAA records repository. Identify the state agency or local body likely to hold the records and its public access contact. No mandatory form or written request is required; a written description preserves the dates, categories and receipt trail. Maine: send a specific request to the holding body

The FAQ says Maine citizenship is not required. Request existing records: the body need not create a new report or answer a research questionnaire. Narrow categories and dates before sending. Maine: request, acknowledgment, cost and redaction FAQ

Separate acknowledgment from production

The holding office must acknowledge a sufficiently described request within five working days. Within a reasonable time, it must give a good-faith, nonbinding completion estimate and make a good-faith effort to meet it. Five working days is not a universal production deadline. Maine: request, acknowledgment, cost and redaction FAQ

Read costs before approving them

Unless another law or court order controls, standard black-and-white copies cost at most ten cents per page; electronic delivery has no per-page copy charge. Staff time is free for the first two hours per request, then actual search, retrieval and compilation costs are capped at $25 an hour. Compilation includes review and redaction. Conversion, supplied storage devices and mailing can cost extra. Maine: current access, fees and protective-order procedures

The FAQ describes advance notice when estimated total costs exceed $50. Advance payment before work may be required above $100 or after a properly assessed unpaid fee. Indigency or qualifying public-interest waivers are discretionary. Maine: request, acknowledgment, cost and redaction FAQ

Ask for lawful portions and a written denial

Confidentiality and privilege exceptions can apply. The custodian considers whether confidential information can be adequately redacted before release; governance records are not automatically open in full. Maine: request, acknowledgment, cost and redaction FAQ

Within five working days, a refusal requires a written denial reason or notice that full or partial denial is expected after review. A denial must cite statutory authority. The current statute requires protective-order procedures for an unduly burdensome or oppressive request, including qualified 60-day filing and advance-notice rules. Copy and adapt the request

Replace bracketed fields, choose narrow dates and use the holding body's current contact route. Keep a copy of the request and receipt. Maine: send a specific request to the holding body

Subject: Maine FOAA request: plate-reader governance records

Under Maine's Freedom of Access Act, 1 M.R.S. sections 408-A and 409, I request copies of the following existing records held by [body] for [start date] through [end date]:

1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.

4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful redaction or withholding.

This request does not assert that the body operates this technology or holds each category. It seeks existing governance and spending records, rather than a new analysis, individual plate detections, movement histories or sensitive operational security details.

I prefer electronic delivery in the medium in which the records are stored, where available under section 408-A(7), to [email]. Please identify any applicable confidentiality-separation or format limitation.

Please acknowledge receipt and provide the applicable good-faith time and cost estimates. If clarification would help identify the records or reduce costs, please contact me.

Please provide any required written denial notice and cite the statutory authority for a denial. Please consider releasing portions that can lawfully be separated from confidential information.

Before charges exceed [$ amount], please provide an itemized estimate and contact me so I can consider proceeding, modifying or cancelling the request. Identify staff, conversion, copying, device and mailing costs as applicable, and any lawful advance payment. This request does not authorize charges above that amount.

Please consider a fee waiver based on [truthful applicable indigency or public-interest grounds]. This does not assert an automatic waiver or that all electronic delivery is free.

Keep mediation separate from a court appeal

The Public Access Ombudsman reviews FOAA complaints, attempts mediation, answers access questions and provides advisory guidance. The official page supplies a public contact route. Asking for help is distinct from filing a court appeal; verify any deadline effect rather than assuming mediation extends time. Maine: Public Access Ombudsman assistance

Section 409(1) permits an aggrieved person to appeal a records refusal, denial or failure within thirty calendar days after receipt of its written notice. The specified Superior Court venue is the Maine county where the person resides or the agency has its principal office. Keep the written notice and receipt date; promptly check the route for delay or failure without a written notice. Maine: records appeals and qualified remedies

A court can order disclosure when the refusal lacked just and proper cause. Attorney fees are discretionary for a substantially prevailing plaintiff upon a bad-faith finding, with a statutory tribal exception. A complaint is not a guaranteed award or disclosure. Maine: records appeals and qualified remedies

Sources and scope

Five primary sources checked 10-24-2026. The statute pages identify a 10-05-2026 extraction; section 408-A includes 2025 amendments. Current statutory court venue and protective-order provisions control older conflicting FAQ descriptions. This focused guide does not claim an exhaustive exemption, indirect-amendment or case-law audit.
