Find the holding body and its custodian

Section 44:33.1 requires public custodian contact information, including internet publication. It also requires reasonable notice that information submitted to the body may become public record. Louisiana: published custodian contact and submission notice

Treasury's request page illustrates why the destination matters: identify the proper agency, describe records specifically and avoid unrelated private information. It warns that submitted documents may be subject to the Public Records Law. Its form is for Treasury records. Louisiana Treasury: holding-agency and request-publicity example

Check eligibility before making a statement

Section 44:31 grants inspection, copying and reproduction rights to persons of the age of majority and separately addresses obtaining copies, subject to other legal limits. The custodian bears the burden of establishing nondisclosure. Louisiana: qualified access and custodian burden

Section 44:31.1 has special limits for a sentenced felony prisoner who has exhausted appellate remedies and seeks records outside qualifying post-conviction grounds. It also limits office-of-governor records access and enforcement to qualifying Louisiana residents, with permitted identity, age and residency verification. The template below concerns records outside that office; do not assume every request has identical eligibility. Louisiana: special eligibility and Governor residency rules

Distinguish immediate availability from active use

Section 44:33 calls for immediate presentation when a public record is immediately available and not in active use. If active use prevents access, prompt written certification must set a day and hour within three days, excluding Saturdays, Sundays and legal public holidays. Other segregation provisions have qualifications; three days is not a universal copying-completion rule. Louisiana: immediate availability and active-use certification

Request a written determination and realistic estimate

If public-record status is questioned, section 44:32(D) requires a written determination, reasons and legal basis within five days, excluding Saturdays, Sundays and legal public holidays. The section permits age/identification inquiries and clarification; a substantial-disruption denial requires reasonable narrowing attempts. Louisiana: access duties, qualified fees and written determination

Section 44:35 separately permits court proceedings after a custodian's denial, or after five excluded-weekend/holiday days without a written determination or reasonable time estimate for collection, segregation, redaction, examination or review. Five days does not always mean delivery of every copy. Preserve the request, receipt, response and estimate. Louisiana: qualified court trigger, venue and remedies

Read the applicable copying schedule

Section 44:32 distinguishes local reasonable posted copying schedules from state uniform or otherwise statutory fees. Electronic transmission can carry qualified charges; advance payment and properly notified unpaid fees matter. Inspection/review generally has no fee, subject to statutory exceptions, including authorized after-hours arrangements. Eligibility for reduced/free copies is qualified and differs for state and local records. Louisiana: access duties, qualified fees and written determination

The Legislative Auditor explains that political subdivisions do not automatically use the state fee schedule. Its guidance says a maintained format should be supplied when held, but an unmaintained conversion is not required. Do not assume every emailed file is free or one per-page amount applies to every custodian. Louisiana Legislative Auditor: fee and stored-format guidance

Governance categories do not override protected material

Section 44:3 has specific pending-criminal-litigation, confidential-source, security, investigative-technique and other law-enforcement limits. Ask for existing oversight records while allowing lawful withholding; naming a policy or agreement does not prove every detail is public. Louisiana: selected law-enforcement exclusions

Section 44:32(B) permits separating nonpublic content and making the public record available. Request lawful portions without assuming every mixed record has an unconditional disclosure rule. Louisiana: access duties, qualified fees and written determination

Copy and adapt the request

Replace brackets, narrow dates and confirm the published custodian. Include only truthful eligibility statements and necessary contact information. Louisiana: published custodian contact and submission notice

Subject: Louisiana public records request: plate-reader governance

Scope note: This starting template concerns records held outside the office of the governor. Review the separate eligibility rules before adapting it for that office or for a restricted post-conviction request. Do not make an untrue age, identity, residency or other eligibility statement.

Under Louisiana's Public Records Law, La. R.S. 44:1 et seq., I request copies of these existing records held by [public body] for [start date] through [end date]:

1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.

4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.

This request does not assert that the body uses the technology or holds every category. It seeks existing governance and spending records rather than a new analysis, individual plate detections, movement histories or sensitive operational security details.

I prefer copies in the electronic format in which the records are maintained, delivered to [email], where available. Please identify any format limitation; this does not demand a new conversion.

If some content is not public, please consider separating it and providing the lawfully releasable material. If a record's public status is disputed, please provide the applicable written determination, reasons and legal basis. If collection, segregation, redaction, examination or review requires more time, please provide a reasonable estimate.

If active use prevents immediate access, please provide the applicable written certification and appointment. If the record is not in your custody or control, please provide the applicable written absence certification with the location/custody information known to you.

Before charges exceed [$ amount], please provide an estimate and contact me so I can consider proceeding, narrowing or cancelling. Please identify the governing state/local or other statutory fee schedule, copying or electronic-transmission charges, any lawful advance payment and any applicable outstanding balance. This request does not approve charges above that amount.

Please consider any available reduction based on [truthful applicable eligibility and grounds]. This does not assert an automatic waiver, unlimited free copies or a statewide local fee rate.

Ask for an absence certification when appropriate

Section 44:34 requires prompt written certification when an authorized request concerns a record outside the recipient's custody or control. To the recipient's knowledge and belief, it covers why the record is absent, its location, current custodian and transfer details. This is not proof that every requested category exists. Louisiana: absent-record certification

Use the correct court route and qualified remedies

Section 44:35 places enforcement in district court in the parish of the custodian's office, with de novo review and the custodian's withholding burden. It provides prevailing-requester fees, discretionary partial-success fees, a statutory fee cap and qualified damages/penalties. Do not treat a request or delay as an automatic award. Check current filing requirements promptly; the five-day trigger is not a universal deadline for a requester to sue. Louisiana: qualified court trigger, venue and remedies

Is three days always the deadline to deliver copies?

No. Section 44:33 ties its appointment provision to records unavailable because of active use. Louisiana: immediate availability and active-use certification

Does every local body use the state copying schedule?

The Legislative Auditor distinguishes political-subdivision reasonable fees from the state schedule. Louisiana Legislative Auditor: fee and stored-format guidance

Can anyone assume the same right to Governor records?

Section 44:31.1 imposes Louisiana residency and other qualifications for that office. Louisiana: special eligibility and Governor residency rules

Ten primary sources checked 10-24-2026. Selected current statutory access, special eligibility, costs, availability, absence, enforcement and law-enforcement provisions were read with Legislative Auditor guidance and Treasury's public request notice. The special Governor residency rule is retained. This focused guide does not claim an exhaustive indirect-amendment, exemption or case-law audit.
