Find the custodian for the agency holding the records
The Attorney General explains that Kansas has no central custodian for every public record. Request the holding agency's custodian, procedures and fee schedule. A freedom of information officer can assist with KORA information without becoming the requester's lawyer or advocate. Kansas Attorney General: custodian and enforcement routes
Written requests and identity checks have limits
Section 45-220 permits written requests and proof of identity, but no mandatory particular request form. Generally the required information is the name, address and what establishes the records sought and right of access, subject to qualified certifications. Its plate-reader routing rule directs captured-data or system-location requests to the agency owning, leasing or contracting for the system. That routing rule does not itself require disclosure. Kansas: request procedures and plate-reader routing
Section 45-230 restricts specified knowing transfers of public-record lists of names and addresses for selling or offering property or services, with statutory exceptions. A requested certification must be truthful. The sample focuses on governance rather than marketing lists. Kansas: qualified names-and-addresses use restriction
Three business days is an action rule
Section 45-218 requires action as soon as possible, by the end of the third business day following receipt. When access is not immediate, the explanation must detail the delay and identify the place and earliest inspection time and date. On request, a denial statement with specific legal citations is due by the end of the third business day following that statement request. These are distinct clocks, not a guarantee that every copy arrives within three days. Kansas: access, response and denial statement
Use the current fee controls
Section 45-219 allows reasonable fees and advance payment. Actual copying costs may include review/redaction, with unrelated incidental costs excluded. Staff charges use in good faith the lowest-cost category reasonably necessary, based on wage or salary without benefits. Itemization is available on request. Other statutory fees and branch-specific authorities qualify the rules. Executive-branch fee reasonableness may be appealed to the Secretary of Administration. Kansas: actual costs, staffing and fee discussions
If staff time exceeds five hours or estimated staff cost exceeds $200, reasonable interactive contact about cost mitigation is required. The requester need not mitigate, but failure to respond by the end of the third business day after reasonable contact deems the request withdrawn until subsequent contact. Monitor the supplied response channel. Kansas: actual costs, staffing and fee discussions
Request governance records while preserving exemptions
Section 45-221(a)(55) covers records containing captured plate data or concerning system locations. Other privacy, investigation and security exceptions can apply. Subsection d requires separating or deleting protected material and releasing what remains subject to disclosure, with qualifications for identifiable people. A contract or policy is not automatically open in full. Kansas: exemptions and separating releasable material
Copy and adapt the request
Replace brackets, narrow the date range and keep the request and receipt. Ask about a usable format and applicable procedures. Kansas: request procedures and plate-reader routing

Subject: Kansas Open Records Act request: plate-reader governance
Under the Kansas Open Records Act, I request access to and copies of these existing records held by [agency] for [start date] through [end date]:
1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.
2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.
3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.
4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.
The categories do not assert that this agency uses the technology or holds every record. This request seeks governance and spending records, not individual plate detections, movement histories, system locations or sensitive operational security details. Please separate protected material and provide the remaining portions subject to disclosure.
I prefer electronic delivery to [email], if practicable. Please identify any format limitation and a practical alternative. If another custodian is appropriate, please provide the custodian's name and location if known or readily ascertainable.
Please act as soon as possible and no later than the end of the third business day following receipt. If access is not immediately possible, please explain the cause of delay in detail and identify the place and earliest time and date for inspection. I also request a written statement of any denial with its specific legal basis, within the separate statutory period following this statement request. This does not assert that all copies must be delivered in three days.
Before charges exceed [$ amount], please contact me with an estimate and any lawful prepayment requirement. I request itemized charges and the applicable fee schedule. This request does not authorize charges above that amount. Please use [chosen contact method] for responses and any cost discussion.

Optional certification only if required and true: [I do not intend to use or make available lists of names or addresses for selling or offering property or services to listed people or residents, within the restrictions of K.S.A. 45-220(c)(2).]
A complaint is a separate step
The Attorney General's FAQ describes enforcement by that office, county/district attorneys or private citizens. Its policy refers local-government complaints to the local prosecutor; that prosecutor can request Attorney General assistance for a conflict or another reason. An original records request is not an enforcement complaint. Kansas Attorney General: custodian and enforcement routes
The complaint route requires the prescribed form and an attestation under penalty of perjury. It warns that the agency/official receives the complaint and that others may access it under KORA. The office represents the State, not the complainant privately; review can end in referral, investigation, remedies or closure. Preserve supporting documents and check deadlines promptly. This guide files nothing. Kansas Attorney General: complaint form and disclosure notice
Court enforcement has separate requirements
Section 45-222 provides district-court proceedings in the county where the records are located, with de novo review and the compliance burden on the agency. Fee awards depend on statutory findings about good faith and a reasonable factual/legal basis; an unsuccessful bad-faith action can also expose a plaintiff to costs and fees. Disclosure and an award are not guaranteed. Check the applicable filing requirements promptly. Kansas: judicial enforcement and qualified fees
