Use the designated custodian
Label the message as a public records request and send it to the designated custodian. Section 74-103 says an agency has no obligation to respond to a request that does not comply with that routing requirement. Keep evidence of delivery. Idaho Legislature: response periods and denials
The public-record definition covers public-business writings prepared, owned, used or retained by state/local agencies regardless of form, with a personal-notes qualification. It does not establish that any particular police agency uses a plate reader or holds the requested records. Idaho Legislature: definitions and residency
Identify residency truthfully before choosing a clock
Section 74-101 defines a resident through at least thirty continuous days of Idaho domicile, excluding a full-time student resident elsewhere, and includes specified domestic entities and qualifying family members. A workplace, vacation home or part-time residence is not domicile. Employee-of-resident wording also appears in the response and fee provisions; confirm that classification rather than selecting it casually. Idaho Legislature: definitions and residency
Section 74-102 requires contact information and a written residency attestation or affirmation under oath, allows email requests/delivery, and calls for specific subjects/dates. Complete the declaration truthfully. Idaho Legislature: access, fees and declaration
Resident working days and nonresident days differ
Section 74-103 gives residents three working days for a grant or denial. Its separate nonresident provision, for a person neither resident nor employed by a resident, uses twenty-one days. A written locate/retrieve extension provides records within ten working days for residents or thirty-five days for nonresidents, measured following the request. The nonresident text does not say working days. Electronic conversion can instead require written notice and a mutually agreed production time. Idaho Legislature: response periods and denials
The July 2026 Attorney General manual calls the nonresident initial period calendar days, but its extension answer says working days. Its later denial answer also uses an unqualified ten days. Those summaries should not replace the current statute's separate clocks and allotted-time deemed-denial provision. Idaho Attorney General: July 2026 manual
Check the fee category before accepting an estimate
Section 74-102 generally excludes residents' first two labor hours and hundred paper pages, subject to other statutory fees. Check necessary-qualified-personnel rate limits, nonresident/employee classification, electronic costs, itemization, aggregation and prepayment before accepting charges. Idaho Legislature: access, fees and declaration
Its mandatory resident waiver requires significant contribution to understanding government, no primary individual interest, and insufficient resources preventing access if charged. Public interest alone is insufficient. Idaho Legislature: access, fees and declaration
Keep the request focused on existing governance records
The July 2026 manual explains that agencies need not create a new record or supply a format outside their normal use. Request existing policies, contracts, retention schedules, sharing agreements and aggregate audits over specific dates. A request is not proof that the agency possesses each category. Idaho Attorney General: July 2026 manual
Section 74-112 requires separation of exempt and nonexempt material; an agency cannot deny the nonexempt part merely because it shares a record with protected information. Idaho Legislature: separate protected material
Section 74-124 has qualified investigatory-record protections, including enforcement, privacy, sources, techniques and safety. Inactive investigations retain specified protections. It also provides a particular judicial route with discretionary prevailing-party costs/fees. A governance request does not establish that every policy or contract provision is disclosable. Idaho Legislature: investigatory records
Police and other offices have different submission routes
Idaho State Police directs record requests to its linked Public Records Center. Its general contact form is not monitored by the records custodian, does not accept such requests and will not forward them. Use the current official records link, rather than the ordinary inquiry form. Idaho State Police: records routing notice
Boise Police requires written requests and provides an online form, in-person option and records contact. Its FAQ uses business days for nonresident periods, which differs from section 74-103's days wording. Confirm the statutory clock with the custodian. Incident-specific fields do not establish that a governance request requires an invented incident, birth date or case number. Boise Police: local written request route
The Attorney General's own records page offers its form/mail route and contact/declaration instructions. That page concerns records held by that office, not a statewide police-request clearinghouse. Its stated amendment date does not replace the Legislature's current section text. Idaho Attorney General: its own records route
The judiciary directs court-record access through Idaho Court Administrative Rule 32 and identifies separate case-record and administrative contacts. Do not assume this police-governance template controls access to a court file. Idaho Courts: separate court-record access
Copy and adapt the request
Replace brackets and choose dates/categories that the custodian can locate. Complete the actual residency declaration before submission; this downloadable text neither declares residency nor sends a request. Idaho Attorney General: its own records route

To: [Designated records custodian of holding Idaho agency]
Date: [MM-DD-YYYY]
Subject: Public records request: plate-reader governance
Under the Idaho Public Records Act, I request these existing records held by [agency] for [start date] through [end date]:
1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.
2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.
3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.
4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.
These categories do not assert that this agency uses the technology or holds every record. I seek existing governance and spending records, not new research, individual detections, movement histories or sensitive security details.
I prefer an existing electronic copy to [email]. Please identify format or conversion limitations before proceeding.
Please separate protected material and provide the remaining nonexempt portions. For any denial, please identify its statutory basis and the applicable review procedure and time period.
Before charges exceed [$ amount], please provide an itemized estimate and any lawful advance-payment requirement. This request does not authorize charges above that amount or claim a fee waiver.

Signature/declaration required by the holding agency: [Complete truthfully before submission]
Preserve a denial and the earliest review trigger
Section 74-103 requires written whole/partial denials with statutory authority, review rights/time periods and the specified attorney-review or consultation-opportunity statement. Failure to respond within the allotted response time is deemed denial. Do not substitute a universal ten-day silence rule. Idaho Legislature: response periods and denials
Section 74-115 names district-court proceedings where the records or part are located as the remedy. A petition contesting a mailed denial/partial denial is due within 180 calendar days of mailing. Certain section 74-107 claims require naming/serving the submitting party. Disputed records must be retained through the applicable longer period. The section also limits using this law to supplant discovery. Idaho Legislature: court petition and disputed records
For silence, the manual says the 180-day period begins at deemed denial. It also explains that an internal agency appeal is not a prerequisite to the statutory court route. Preserve the original receipt/response dates and check promptly; do not assume informal follow-up restarts a filing period. Idaho Attorney General: July 2026 manual
Under section 74-116, reasonable prevailing-party costs and attorney fees depend on a court finding that the request or refusal was frivolously pursued. That condition can matter to either side; a denial does not automatically produce a requester fee award. The investigatory-record provision has its own cost language. Idaho Legislature: court decision and qualified fees
Questions and answers
Can someone outside Idaho request records?
Yes, but classification affects the response and fee provisions; the public access right is not limited to residents. Idaho Legislature: access, fees and declaration
Are thirty-five working days the statute's nonresident extension?
The current section says thirty-five days; it expressly uses working days for the resident period. Idaho Legislature: response periods and denials
Does this template claim a fee waiver or Idaho domicile?
No. Its declaration must be completed truthfully and its estimate language does not assert waiver eligibility. Idaho Attorney General: its own records route
Sources and scope
Twelve primary sources checked 10-24-2026, including actual public rendered statute bodies where the automated reader failed, the current linked July 2026 Attorney General manual, official agency routing and judicial guidance. Manual/agency-summary clock differences remain explicit. The obsolete July 2025 manual URL returned404 and was not substituted as current. The linked ISP portal was reached but its form content was not independently verified. This is not an exhaustive amendment, exemption or case-law audit.
