Send a formal request to the holding agency

OIP says to send a written request to the state or county agency holding the records, with contact information, a reasonable description and the requested delivery method. OIP does not hold other agencies' records or answer for them. Hawaii OIP: request and assistance process

Its rules quick guide covers state/county executive and legislative agencies and the judiciary's administrative functions. A court case file has a different context from a police-governance request. Hawaii OIP: response and production stages

The April 2026 model request form is optional and permits a name or alias, but enough contact information is required for correspondence. This guide requests existing governance records without asserting that a specific agency operates plate readers. Hawaii OIP: April 2026 request form

Notice and production have different stages

OIP's quick guide gives fully disclosable records a reasonable disclosure period no longer than ten business days. Other requests, including partial disclosures, generally require notice within ten business days, followed by public portions within five business days of notice or applicable prepayment. Qualified extenuating circumstances allow acknowledgment within ten business days and notice within twenty, followed by the applicable production stage. Incremental disclosures have separate schedules. These are not universal ten-day delivery promises. Hawaii OIP: response and production stages

The adopted rules allow good-faith incremental production for voluminous records when extenuating circumstances exist. Subsequent increments generally follow within twenty business days of the prior increment or incremental prepayment. The notice must explain applicable circumstances and arrangements. Hawaii OIP: adopted chapter 2-71

Answer clarification and payment instructions promptly

OIP's requester-responsibility review explains the twenty-business-day response to clarification/prepayment notices, measured from postmark or email date, and presumed abandonment for failure to act. The adopted rule also addresses arrangements after the record is made available. Keep those notices and actual dates. Hawaii OIP: requester responsibilities

The review describes possible prepayment of half the estimated search/review/segregation fees when over $30, all other lawful preparation/transmission costs, and prior outstanding fees. An approved request later abandoned can leave a balance for work already performed. An estimate ceiling is not a promise that no lawful charge can arise. Hawaii OIP: requester responsibilities

Check the fee category and waiver facts

Chapter 2-71 ordinarily sets search at $2.50 per fifteen minutes or fraction and review/segregation at $5, with the first $30 of those fees unassessed. Outside search services and agencies authorized by statute to recover actual costs have qualifications; other lawful fees remain separate. Request an itemized bill in writing. Hawaii OIP: adopted chapter 2-71

The April 2026 form explains that a qualifying $60 public-interest waiver replaces the $30 allowance, rather than adding to it. It requires an identified requester's factual statement: agency operations, records not readily public, and primary intent plus actual ability to disseminate widely. It does not erase copying/transmission costs or establish that every public-interest requester qualifies. Hawaii OIP: April 2026 request form

Ask for existing records and releasable portions

Section 92F-11 generally opens government records unless restricted by law and does not require a new compilation/summary when information is not readily retrievable in the requested form. Narrow policy, contract, retention, sharing and audit categories by date. Hawaii Legislature: existing records access

Section 92F-13 includes qualified privacy, litigation/discovery, legitimate-government-function, other-law and legislative-work protections. Requesting a policy or contract does not establish that all its contents are open. Hawaii Legislature: disclosure exceptions

Chapter 2-71 requires assessment of reasonable segregation, access to disclosable portions and notice of protected portions with specific legal authority. Hawaii OIP: adopted chapter 2-71

For Department of Law Enforcement records, its current page provides a model form and email/mail/hand-in route with written-description/contact/delivery requirements. That route concerns that department; use the correct county police contact for records held there. Hawaii Law Enforcement: its request route

Copy and adapt the request

Replace brackets and remove the optional waiver line unless truthful supporting facts are supplied. The model form permits an alias but still needs a way to correspond. This text does not send a request or submit a waiver claim. Hawaii OIP: April 2026 request form

To: [Hawaii state or county agency holding or administratively controlling the records]

Date: [MM-DD-YYYY]

Subject: Formal UIPA request: plate-reader governance

Under part II of Hawaii's Uniform Information Practices Act, I request copies of these existing records held by [agency] for [start date] through [end date]:

1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.

4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.

These categories do not assert that this agency uses the technology or holds every record. I seek existing governance and spending records, not new research, individual detections, movement histories or sensitive security details.

I prefer an existing electronic copy to [email or chosen delivery arrangement]. Please identify any format limitation or clarification needed.

Please provide a notice identifying any withheld record or portion and the specific legal authority. Please provide reasonably segregable public portions.

Before charges exceed [$ amount], please provide a good faith estimate, any required prepayment instructions, and an itemized bill on this written request. This template does not authorize charges above that amount or assert public-interest waiver eligibility.

Please identify any extenuating circumstances, incremental disclosure schedule and requester action required. I will need to respond to clarification, arrangement and lawful prepayment instructions within the applicable period.

Name or alias: [Chosen identifier]

Contact information sufficient for correspondence: [Email or mailing arrangement]

Other information required by the holding agency's process: [Complete truthfully]

Optional separate public-interest fee-waiver request: [Include only if supported by truthful identifying facts and the actual waiver criteria; otherwise remove this line]

Distinguish help getting a response from an appeal

OIP offers free Request for Assistance help when an agency misses its response or gives specified incomplete responses. Include the original request and all responses. This process seeks a proper written response; it does not decide whether a legal withholding is justified. Hawaii OIP: request and assistance process

The April 2026 assistance form asks for the request/denial and contact information. Its note excludes copying-fee issues under section 92-21 and discretionary public-interest waiver decisions from the matters it will address. Do not assume a fee complaint automatically has the same review route as denial of records. Hawaii OIP: April 2026 assistance form

For a records appeal based on a written request, rule 2-73-12 generally gives one year from receipt of written whole/partial denial, or from the last day allowed for the agency's written response when none is sent. Include contact information, identify the records and attach the denial or a written nonresponse statement. This differs from open-meeting and tax-opinion periods. Hawaii OIP: administrative appeal rules

OIP's guide says a UIPA appeal is optional before court, has no fixed decision deadline and allows a reconsideration request within ten business days after issuance. The agency's ten-business-day response to an appeal notice is not a promise that OIP will decide the dispute in ten days. Hawaii OIP: appeal guide and decision timing

Court deadlines are separate from the OIP filing period

Section 92F-15 allows an aggrieved requester's disclosure action within two years after agency denial, states circuit-court venue options and places the nondisclosure burden on the agency. Reasonable attorney fees/expenses depend on prevailing in an action under that section. Do not assume an informal follow-up resets a deadline. Hawaii Legislature: requester judicial enforcement

Section 92F-15.5 preserves the requester's court route after an OIP decision and describes disclosure or written notice when denial is upheld. Check the actual procedural posture and applicable dates promptly. Hawaii Legislature: alternative OIP appeal

Section 92F-43 separately gives an agency thirty days from OIP's final decision to seek its specified judicial review, with service and record requirements. That agency deadline should not be presented as the requester's universal court deadline. Hawaii Legislature: agency judicial review

Sources and scope

Fourteen primary sources checked 10-24-2026. Current statute bodies, OIP request/timing guidance, actual adopted chapter2-71 text, April2026request/assistance forms, older responsibility review, appeal rules/guide and Law Enforcement route were read. Section92F-15.5 was read in the public browser after automated403. Upload-folder years were not treated as rule revision dates: chapter2-71 retains its1998/1999adoption/effect and the responsibility review says05-08-2014.
