Delaware FOIA requests for surveillance oversight
Check Delaware citizenship eligibility, request existing governance records from the holding body, distinguish a 15-business-day response from production, and preserve the correct review route.

Check the citizenship qualification first
The DOJ manual says Delaware's FOIA grants access to citizens of Delaware. A public body may voluntarily fulfill a noncitizen's request but can deny it on that ground alone. Use a truthful eligibility statement. Living outside Delaware does not justify claiming Delaware citizenship or assuming a guaranteed statutory remedy. Send a specific written request to the holding body
DOJ guidance directs written requests to the appropriate public body with adequate record descriptions and contact information. The standard form is optional when the request otherwise follows the body's policy. Identify the holding agency or local body and its FOIA coordinator. Delaware DOJ: request and petition distinctions
The state portal links to a form with a public-body selector and separate links for certain departments. Check the actual destination before supplying information; a request for local records belongs with that public body. Delaware: official request portal entry
The live form warns that a request or petition, included information and attachments may themselves become public records. Include the contact and record-description information needed for the request; avoid adding private movement histories or unrelated sensitive documents. Ask for records that already exist
DOJ explains that FOIA does not require creating a new record or answering a research questionnaire. Retention obligations arise under separate laws. A request for an existing policy or report does not establish that the public body uses the technology or possesses every category. Delaware DOJ: request and petition distinctions
Distinguish the response from completed delivery
DOJ guidance describes a response as soon as possible and within fifteen business days. It may provide access, deny access or identify a permitted reason for additional time: voluminous records, legal advice, or stored or archived material. The delay response must give a good-faith time estimate. Fifteen business days is not an unconditional completion deadline. Delaware DOJ: request and petition distinctions
Read the applicable fee schedule before committing
Section 10003(m) provides default fees unless another applicable code sets a different structure. It distinguishes the first twenty standard black-and-white pages from later copying charges and qualified administrative fees for requests requiring over one hour of staff work. Administrative billing uses quarter-hour increments and the lowest-paid capable employee; legal review for exemptions is excluded. An itemized estimate precedes administrative charges. Electronic copies can carry material and administrative costs; advance payment may be required. Policy-based waivers are qualified. Delaware: access, qualified fees and enforcement
Ask for lawful portions without assuming all surveillance records are open
Chapter 100 excludes specified investigative, privacy, confidential and security-related material. Redaction and other legal limits may apply. Governance and spending categories are starting points, not a guarantee that every policy, agreement or operational detail is disclosable. Delaware: access, qualified fees and enforcement
Copy and adapt the request
Replace every bracketed field, keep only the truthful eligibility statement and narrow dates and categories before using the holding body's current submission route. Delaware: linked public form and disclosure notice

Date: [MM-DD-YYYY]
Subject: Delaware FOIA request: plate-reader governance
Eligibility statement: [Keep only the statement that is true: I am a citizen of Delaware. OR I am not a citizen of Delaware and request voluntary access without asserting the statutory entitlement reserved to Delaware citizens.]
Under 29 Del. C. chapter 100, or voluntarily if I am not entitled to statutory access, I request copies of these existing records of [public body] for [start date] through [end date]:
1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.
2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.
3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.
4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.
This request does not assert that the public body operates the technology or holds every listed record. It concerns existing governance and spending records rather than a new analysis, individual plate detections, movement histories or sensitive operational security details.
I prefer electronic delivery in [available format] to [email]. Please identify any applicable format limitation.
Please provide any withholding decision and its reasons in writing and provide portions that can lawfully be released. If the statutory response rule applies and additional time is needed, please identify the permitted reason and a good-faith estimate of the time required.
Before charges exceed [$ amount], please provide an itemized estimate and contact me so I can consider proceeding, modifying or cancelling the request. Identify copying, electronic-material and administrative charges and the applicable fee schedule. Please identify any lawful advance payment required. This request does not approve charges above the stated amount.
Please consider any waiver available under the public body's policy based on [truthful applicable grounds]. This does not assert that every electronic copy or request is free.

Keep a DOJ petition separate from an original request
The DOJ manual describes a nonanonymous petition with contact information, the alleged violation and relevant evidence, including the original request and response when applicable. It states that petitions alleging state-agency records denial must reach DOJ within sixty days; other petitions generally have a six-month period. Receipt cutoffs and additional procedural rules matter. Check the current instructions promptly. Delaware DOJ: 10-01-2025 manual and petition rules
DOJ says its petition determination does not itself issue an injunction or assess penalties against the body. A request to DOJ for its own records is also distinct from a petition disputing another body's handling of records. Delaware DOJ: request and petition distinctions
Check the judicial route and its trigger separately
Section 10005 distinguishes records-denial suits, generally within sixty days, from requests involving state bodies the AG must represent. Those require a timely Chief Deputy petition first; an adverse determination can then have a separate sixty-day Superior Court appeal. Check the body, route and trigger promptly. Delaware: access, qualified fees and enforcement
