Start with the holding agency and truthful access status

The Attorney General's FOIA resources link the current 2026 twenty-second-edition handbook. Use the agency's official records contact and describe existing records precisely, keeping a dated written copy and delivery evidence. This guide requests governance documents without asserting that an agency operates plate readers. Arkansas Attorney General: FOIA resources

Section 25-19-105 grants access to Arkansas citizens with specified incarcerated-felony/representative restrictions. Do not falsely claim citizenship or representation. A person outside that entitlement can ask whether access is voluntary; this template does not establish entitlement. Arkansas State Library: published statute text

A dated 2023 agency policy illustrates coordination through a FOIA officer and division contacts. It also recognizes legal exemptions. That historical department policy is not presented as the current contact list or a procedure binding every police agency. Confirm the actual holding custodian. Immediate access differs from the active-use exception

The 2026 handbook's statutory text requires immediate access to responsive records not in active use/storage. For that exception, the custodian must certify the situation in writing and set a date/hour within three working days. Its brief agency webpage summary should not turn this exception into a routine waiting period. Arkansas Attorney General: 2026 handbook

Its personnel/evaluation provisions instead use a qualified twenty-four-hour determination/notification process. That is separate from a routine policy or contract request. Arkansas Attorney General: 2026 handbook

Ask for existing, reasonably segregable records

Section 25-19-105 permits a readily available medium or a format readily convertible with existing software, without requiring new compilation or creation. It requires reasonably segregable portions after redaction, with indicated deletions; the custodian bears ordinary separation cost. Arkansas State Library: published statute text

The Attorney General describes public-business writings, sound and video as records, while recognizing disclosure exceptions. A policy/contract request does not override confidentiality, privacy, security or other applicable law. Ask for the specific basis and releasable portions rather than assuming the entire document is open. Arkansas Attorney General: FOIA resources

Distinguish ordinary copies from special processing

Ordinary copy fees generally cover actual reproduction/transmission, excluding existing agency personnel search/retrieval/review/copy time, subject to section 25-19-109 and other law. An itemization is required; an estimate above $25 can require prepayment. Noncommercial/public-interest reduction is conditional. Arkansas State Library: published statute text

The published text separately allows discretionary tailored electronic work, with qualified verifiable personnel costs above two hours and rate limits. Law-enforcement audio/visual requests also have a distinct provision. Ask which authority applies; ordinary records, special data work and media should not be assigned one blanket fee rule. Arkansas Attorney General: 2026 handbook

Copy and adapt the request

Replace brackets and narrow the dates/categories. Confirm citizenship or another truthful access basis if required, rather than signing an unsupported statement. This sample does not submit a request, claim a waiver or accept an estimate. Arkansas: dated agency procedure example

Date: [MM-DD-YYYY]

Subject: Arkansas FOIA request: plate-reader governance

Under the Arkansas Freedom of Information Act, I request copies of these existing records held by [agency] for [start date] through [end date]:

1. Written plate-reader operating policies, authorized-use rules, retention schedules and audit procedures effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.

4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.

These categories do not assert that this agency uses the technology or holds every record. I seek existing governance and spending records, not new research, individual detections, movement histories or sensitive security details.

I prefer an electronic copy in a readily available or readily convertible existing format to [email]. Please identify any format limitation.

Please provide reasonably segregable public portions and identify the applicable exemption for anything withheld. If no responsive record exists, or another custodian has administrative control, please provide the applicable written response.

Before charges exceed [$ amount], please provide an itemized estimate identifying the applicable authority, any special electronic or media rule, and any lawful advance-payment requirement. This request does not authorize charges above that amount or assert fee-waiver eligibility.

Name: [Name]

Contact information: [Email or mailing arrangement]

Arkansas citizenship or other access basis: [Describe truthfully if applicable or requested. Do not use this placeholder as a declaration. If not entitled under the Act, ask whether access will be provided voluntarily.]

Other information required by the holding agency's process: [Complete truthfully]

Do not treat every denial as an Attorney General appeal

The Attorney General's division describes its statutory review of personnel/employee-evaluation decisions and advice to specified public officials. That should not be described as a general appeal service for every requester's withheld contract. Check the actual record category and applicable procedure promptly. Arkansas Attorney General: opinion-review scope

The handbook's section 25-19-107 provides immediate circuit-court review: Pulaski County or the requester's residence for state entities, or appropriate judicial districts for local/covered private entities. Its seven-day hearing provision is not a requester filing deadline. Arkansas Attorney General: 2026 handbook

Fee awards have conditions. For qualifying state-case expenses, the statute provides a Claims Commission claim within sixty days of final disposition of the appeal. Do not assume automatic recovery or a follow-up restarting time. Arkansas Attorney General: 2026 handbook

Preserve the request, receipt, written answer, cited exemption, redacted copy and cost itemization. Use those actual facts when checking the proper review route; the sample is an initial request, not a complaint, appeal or court filing. Arkansas Attorney General: opinion-review scope

Sources and scope

Five primary sources checked 10-24-2026. The Attorney General's current link led to the 2026 twenty-second edition, including 2025 changes; selected statutory sections105/107/109/112 and related guidance were read. State Library2025-2026section105/109text, AGreview scope and a clearly dated2023agency-policy example were also read. The Legislature's separate Lexis viewer was opened but its agreement was not accepted; no independent current viewer section text is claimed. This is not an exhaustive amendment, exemption or case-law audit.
