Find the records access officer

The Committee on Open Government directs requests to the agency that maintains the records, through its records access officer. For a local police department, use that department's designated FOIL channel. The Committee does not generally hold another agency's records. New York: holding agency and FOIL guidance

Reasonably describe the records

Section 89 addresses requests for reasonably described records and retrieval of electronically stored data with reasonable effort. Identify the record types and dates, and ask for maintained governance records rather than assuming every proposed item exists. New York Public Officers Law 89

Separate the initial response from production

Within 5 business days of receipt of a reasonably described written request, the agency must provide access, deny in writing or acknowledge receipt with a reasonable approximate response date. That initial response is not an unconditional complete-production deadline. New York: response timing

The Committee explains that a need for more than 20 business days from acknowledgement requires a written reason and a specific reasonable date. It cautions that the framework does not authorize unnecessary delay. Keep each acknowledgement and promised date. New York: response timing

Subject: FOIL request: plate-reader governance records

Under New York's Freedom of Information Law, Public Officers Law Article 6, I request these records maintained by [agency] for [start date] through [end date]:

1. Plate-reader operating policies, retention schedules, audit procedures and training materials effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing lists of sharing partners and executed sharing agreements effective during the period.

4. Existing access or query audit logs for [narrow date range], subject to lawful redaction. This request concerns system governance rather than an individual's movement history.

Please provide electronic copies in an existing available format. Please notify me before charges exceed [$ amount].

Please provide the applicable response within five business days. If acknowledging the request rather than providing the records, please give the required reasonable approximate response date and any later required written explanation and specific production date.

If any part is denied, please state the legal basis, provide accessible portions, and identify the proper appeals officer and applicable appeal procedure. If a special statutory procedure applies, please identify it.

Read the denial before choosing an appeal deadline

The ordinary section 89(4) procedure allows a written appeal within 30 days of denial to the agency head or designated appeals officer. The appeal decision is due within 10 business days of receipt, providing access or written reasons for further denial. New York Public Officers Law 89

A different procedure under section 89(5) can apply to certain claimed commercial or critical-infrastructure records. Its appeal period is 7 business days from receipt of written denial. Check whether that subsection applies before relying on the ordinary 30-day period. New York: law text updated 05-29-2026

Keep the administrative trail

Section 89 provides Article 78 court review after an adverse appeal determination, with special procedures where applicable. Preserve the request, receipt, responses and appeal determination, and review the applicable court procedure before pursuing it. New York Public Officers Law 89
