Request records of or belonging to the public body

Section 84-712.01 defines covered records broadly across physical forms and public entities. Public data remains public when computerized, subject to express statutory confidentiality. Fiscal records, including contracts' spending records such as invoices and purchase orders, receive a rule of liberal construction. The location of a file alone does not establish whether it belongs to a public body. Nebraska: records and fiscal transparency

The Attorney General's outline explains that the law does not require new research, answers to questions or creation of records that do not exist. Start with identifiable policies, executed agreements and spending documents, with dates narrow enough to locate them. Nebraska Attorney General: request and fee guidance

Access and fee status are different questions

Section 84-712 covers residents and other interested people. For fee purposes, resident means Nebraska domicile and includes news media regardless of domicile. Resident rules exclude existing employee salary/pay for the first eight cumulative hours of listed work and bar charges for review seeking a legal withholding basis. Nonresident rules permit specified proportional labor and attorney-review charges. This is not eight free hours for every requester. Nebraska: access, formats, costs and resident definition

Check actual added costs and the format

Copy fees generally use actual added costs, qualified by other statutes and approved portal fees. A deposit can be required above a $50 estimate; public-interest reduction or waiver is discretionary. Existing maintained/produced formats are covered when copying equipment is reasonably available; new formats are not required. Accessible website records can be supplied by location, with an exception for requesters lacking reasonable Internet access. Nebraska: access, formats, costs and resident definition

The 07-2024 outline explains that LB43 superseded the earlier nonattorney withholding-review fee holding under the resident provision. Historical four-hour discussion is not the current resident rule. Nebraska Attorney General: request and fee guidance

A four-business-day response has alternatives

The outline describes a prompt response within four business days after actual written-request receipt: estimate plus access/copies, lawful denial or qualified delay explanation with earliest fulfillment and modification/prioritization opportunity. Exclude receipt day, weekends and office closures. Respond to the estimate within ten business days to proceed, negotiate or withdraw; otherwise fulfillment stops. Nebraska Attorney General: request and fee guidance

Ask for public portions and a meaningful denial

Current section 84-712.05 contains qualified investigation, personnel, security and other withholding categories. Its published text correlates two 2026 amendments operative/effective 07-18-2026. The older outline is not an exhaustive current exemption list, and an oversight request does not make every detail disclosable. Nebraska: qualified withholding categories

Section 84-712.06 requires disclosure of reasonably segregable public portions after deleting what may be withheld. This does not require release of protected material. Nebraska: reasonably segregable public portions

A denial must describe the withheld contents, connect specific reasons and statutory subsections to particular portions, identify the responsible official/employee and explain review rights. Section 84-712.04 also makes the body's file of denial letters available on request. Nebraska: required written denial information

Copy and adapt the request

Replace brackets, narrow categories and retain the request/receipt. Select fee-status information truthfully. Nebraska Attorney General: request and fee guidance

Subject: Nebraska public records request: plate-reader governance

Under Nebraska Revised Statutes 84-712 and following, I request these existing records of or belonging to [public body] for [start date] through [end date]:

1. Written plate-reader operating policies, retention schedules, authorized-use rules and audit procedures effective during the period.

2. Executed equipment and data-service contracts, amendments, purchase orders and invoices during the period.

3. Existing executed data-sharing agreements and existing lists of sharing partners effective during the period.

4. Existing aggregate compliance or audit reports for [narrow date range], subject to lawful withholding or redaction.

These categories do not assert that the body uses this technology or holds every record. I seek existing governance and spending records rather than new research, answers to questions, individual detections, movement histories or sensitive security details.

I prefer copies in an electronic form already maintained or produced, delivered to [email]. Please identify any limitation or accessible website location. Please provide a timely statutory response, with the required explanation, earliest practicable fulfillment date, cost estimate and opportunity to modify or prioritize if qualified delay is necessary.

If records are withheld, please provide the description, specific reasons correlated to portions and legal citations, responsible decision maker and review-rights information required by 84-712.04. Please release reasonably segregable public portions after lawful deletions.

Please identify applicable actual added costs and any required deposit before charges exceed [$ amount]. This request does not authorize charges above that amount.

Optional truthful fee-status information: [Nebraska domicile, or news media status without regard to domicile, if applicable. Do not claim a status that is untrue.]

Keep a records petition separate from a meetings complaint

The official Open Government page provides a public-records petition route for withheld records, other response noncompliance and disputed estimated or charged fees. Its separate open-meetings complaint process has a different purpose. Follow the records instructions for a records dispute. Nebraska Attorney General: records petition route

The current petition form requests detailed reasons, a copy of the written records request and all response correspondence. It lists email, fax and postal submission routes. Preserve the documents and check the current form before sending anything. This guide submits no request or petition. Nebraska Attorney General: petition documentation

Understand the review clocks and court qualifications

Section 84-712.03 allows an election between district-court mandamus and an Attorney General petition. The fifteen-calendar-day petition determination period belongs to the Attorney General, not a universal requester filing deadline. After an adverse agency-compliance determination and continued noncompliance, the statute supplies further suit options and a separate fifteen-day clock for the Attorney General after a written litigation demand. Court procedure, the requester's initial showing and the agency's burden matter. Check applicable filing requirements promptly rather than assuming correspondence suspends them. Nebraska: petition and court remedies

Section 84-712.07 permits equitable relief and allows reasonable litigation fees/costs for a complainant seeking access who substantially prevails. An award is discretionary rather than automatic. Nebraska: equitable relief and discretionary litigation costs

Questions and answers

Does nonresident status prohibit a request?

The statute covers other interested people, with different fee rules. Nebraska: access, formats, costs and resident definition

Is every record due in four business days?

Is fifteen days my universal petition filing deadline?

That is the Attorney General's determination clock under the provision described here. Nebraska: petition and court remedies

Sources and scope

Ten primary sources checked 10-24-2026. Current statutory bodies were read with selected 07-2024 Attorney General outline sections and the current petition page/form. The current exception statute includes correlated 2026 amendments; the older outline was not treated as a complete current exemption list. This focused guide is not an exhaustive exemption, indirect-amendment or case-law audit.
